(hereafter referred to as “Colorado Arts Center”, “CACI”, “the Arts Center”, “the Center”, “We” or “Our”) provides this web site, coloradoartscenter.org for the use of the general public (“User”, “You” or “Your”) as well as registered members (“Members”). This web site is offered to You on the condition of Your acceptance without modification of all the terms and conditions as set forth in these Terms and Use and Privacy Policy. By using this site, You are acknowledging Your acceptance of the Terms of Use; violation of these Terms will be grounds for immediate termination of membership and consideration of legal action.
You are prohibited from any unauthorized use of the site including but not limited to:
- posting racially or offensive material;
- promotion of illegal events, or unauthorized posting of nonmember events;
- posting of any information by nonmembers;
- introduction in any form of spam, viruses, Trojan horses or any other malicious software;
- accessing or attempting to access restricted areas of the site, including other member-exclusive areas;
- copyrighted materials.
Monitoring
CACI reserves the right to monitor postings on its pages and to edit, remove, or refuse to post any material We find objectionable, unauthorized, or in violation of the Terms of Use.

This web site contains copyrighted material, trademarks and other proprietary information, including, but not limited to, text, software, photos, video, graphics, music and sound, and are the property of their individual owners. Any unauthorized use is prohibited.

Because it permits posting by members, The ASBC Website is an "interactive computer service” under the CDA. The ASBC is not responsible for, and do not exercise any editorial or other control over, any content posted by Members, but rather merely serves as a "publisher” of such content.

Membership
The Membership area of coloradoartscenter.org is for the exclusive use of CACI Members only. All resources found in the Membership area are for the exclusive use of CACI Members. All information regarding individual Members is the sole property of that member and CACI and will not be shared or sold to outside entities.

CACI provides numerous links to other web sites as a service to the community. No claim to ownership is stated or implied. While CACI endeavors to keep links as current as possible, We are not responsible for dead, missing or otherwise nonfunctional links.
Limitations of Liability
THE Center SHALL NOT be liable for any damages whatsoever, and in particular the Center shall not be liable for any special, indirect, consequential, or incidental damages, or damages for lost profits, loss of revenue, or loss of use, arising out of or related to this website or the information contained in it, whether such damages arise in contract, negligence, tort, under statute, in equity, at law, or otherwise, even if the Center has been advised of the possibility of such damages. SOME JURISDICTIONS DO NOT ALLOW FOR THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, THEREFORE SOME OF THE ABOVE LIMITATIONS IS INAPPLICABLE.
THE CENTER SHALL NOT BE LIABLE TO ANY USER FOR ANY ACTION OR CLAIM RELATED TO THE WEBSITE OR THE SERVICES, WHETHER BASED IN CONTRACT, TORT, NEGLIGENCE OR ANY OTHER THEORY OF LIABILITY, FOR ANY AMOUNT THAT EXCEEDS THE SUM OF: (I) THE MOST RECENT ANNUAL MEMBERSHIP FEE PAID BY THE USER WITHIN THE TWELVE MONTH PERIOD IMMEDIATELY PRIOR TO THE CLAIM, AND (II) ANY FEES ACTUALLY PAID BY SUCH USER FOR SERVICES DIRECTLY RELATED TO THE CLAIM.
Check Acceptance Policy
We will accept checks based on Your acceptance of the following conditions:
- Written for the exact amount of purchase.
- Imprinted with Your company name, address, and bank name; and You may be asked to provide a photo identification (driver's license, state-issued non-driver ID, passport, military ID).
- Returned check service fee: $30.00 or maximum allowed by the State of Colorado (whichever is greater). We will not resubmit checks not honored by Your financial institution.
- We reserve the right not to accept starter checks, payroll checks, third party checks, personal checks, foreign checks, or altered checks.
- Check payments for events must be received five (5) days prior to the event. Check payments must be mailed to: The Colorado Arts Center, Inc., 800 W. 9th Ave., Denver CO 80204
- Refunds for purchases made by credit card are subject to a 10% (of total purchase) processing fee.
- Refunds for purchases made by check or cash are subject to a $5 processing fee.
- There will be no refunds issued for event cancellations within five (5) business days of the event date.
- Unless otherwise specified on the event these refund conditions apply.
- Sponsorships are non-refundable.
Credit Card Dispute Policy
Credit Card Users agree to allow CACI a seven (7) business day cure period to provide a resolution in the case of a dispute. If You feel that You have been charged incorrectly, please call us or send an email to info@coloradoartscenter.org with details of the charged amount, date of charge and the reason You believe an error has been made. CACI will respond with acceptance of Your inquiry, research the charge and provide a response to You within seven (7) business days from the date we receive Your inquiry.
By accepting this agreement, You agree to reimburse CACI for bank and service fees in the event that You do not provide us the seven (7) day cure period to resolve the matter. Additionally, You agree to reimburse The ASBC for all charges associated with collecting this reimbursement if payment is not received by CACI within fourteen (14) business days from the date You are notified that Your dispute was incorrectly lodged.
All refund requests are subject to review by The Colorado Arts Center, Inc.
